Based on observation, interview, record review, and review of the facility's policy, the facility failed to ensure video/audio live feed monitoring and/or recording was not used in place of staff supervision for one of eight sampled clients (Client (C) 5). C5 had a live feed video monitor in his/her bedroom which violated the client's right to privacy.

Findings include:

Review of the facility's policy titled, "Board of Directors Policy on Resident Rights," revised 08/2022, revealed, ". . . 6. Each resident shall have the right to privacy, which promotes the quality of life. The IPP also revealed, ". . . Right Assessment: It has been assessed that [C5's Name] does not understand [his/her] rights and would not be able to advocate for [himself/herself] in the event [his/her] rights were violated in some way . . . Any recommendations for goals relating to rights: none at this time . . . Limitations of Rights: . . . 11. The right to privacy. Why is this limitation being recommended? [C5's Name] has a live time monitor in [his/her] room to monitor for safety due to brittle bones-to help staff be aware of [his/her] safety needs . . ." There was no documented evidence of a behavior plan to address the right restriction nor any evidence of a restoration plan to restore the right.

During an interview on 10/04/25 at 9:15 AM, the facility Director confirmed there was no right restoration plan in place for C5's privacy restriction. The Director stated it was suggested by C5's father. The facility Director also confirmed there was no physical support plan in place either.
